Instructor Terms and Conditions

This document delineates a formal covenant of collaboration between the esteemed educator, herein referred to as the “Instructor,” and the distinguished educational institution known as “oktatacademy.”

Responsibilities of the Instructor:

In the capacity of an instructor, you bear the onus for all material disseminated, encompassing but not limited to lectures, quizzes, coding exercises, practice tests, assignments, resources, answers, course landing page content, labs, assessments, and announcements, collectively denoted as “Submitted Content.”

You warrant that you will not:

  • Engage in any activities that violate oktatacademypolicies or applicable laws.
  • Transmit any content that is unlawful, defamatory, obscene, discriminatory, or otherwise objectionable.
  • Use the Services for any fraudulent or inappropriate purpose.
  • Interfere with or disrupt the integrity or performance of the Services.
  • Attempt to gain unauthorized access to any oktatacademy account or computer system.
  • Modify, adapt, or hack the Services, or falsely imply any association with oktatacademy.
  • Violation of these stipulations may result in the termination of your account and access to oktatacademy Services.

You shall refrain from:

  • Posting or disseminating any content that is inappropriate, offensive, racist, hateful, sexist, pornographic, false, misleading, incorrect, infringing, defamatory, or libelous.
  • Posting or transmitting unsolicited or unauthorized advertising, promotional materials, junk mail, spam, or any other form of solicitation, whether commercial or otherwise, through the Services or to any user.
  • Using the Services for purposes other than providing tutoring, teaching, and instructional services to students.
  • Engaging in any activity that would necessitate obtaining licenses from or remunerating royalties to any third party, including the obligation to pay royalties for the public performance of a musical work or sound recording.
  • Framing or embedding the Services, such as embedding a free version of a course, or otherwise attempting to circumvent the Services.
  • Impersonating another individual or gaining unauthorized access to someone else’s account.
  • Interfering with or obstructing other instructors from delivering their services or content.
  • Misusing oktatacademy resources, including support services.

Content Suitability.

  1. oktatacademy retains the authority to eliminate Course Content from its Platform under the following circumstances:

  1. Content that exhibits low technical quality or otherwise falls short of meeting Course Criteria;
  2. Content that constitutes unsuitable advertising material, distinguished from content with a direct pedagogical purpose.

oktatacademy may, based on reasonable determination, remove content that:

  1. Potentially breaches applicable law; or
  2. Contravenes any of Partner’s regulations governing the conduct of Instructors, presenters, or students. Partner shall furnish oktatacad with a copy of said regulations upon request.

oktatacademy will strive for collaborative resolution with Partner concerning decisions on Course Content removal. However, it retains the prerogative to temporarily suspend content that is reasonably objectionable, pending discussions with the relevant Partner representative regarding the content.

Course Accessibility.

  1. Following the commencement of enrollment for a Course, Partner is prohibited from withdrawing, obstructing, or suspending access, or granting authorization to an Instructor to withdraw, obstruct, or suspend access to the Course Content before the scheduled conclusion date of the Course.

Access to the ONLINE LEARNING PLATFORM

While certain sections of the ONLINE LEARNING PLATFORM may be accessible to the general public, specific segments are limited to registered users who meet the prescribed eligibility criteria. You commit to refraining from accessing any registration-exclusive portions of the ONLINE LEARNING PLATFORM if you fail to meet the eligibility requirements. The Members bear no responsibility for any delays, difficulties, or inability to access the ONLINE LEARNING PLATFORM resulting from various causes, including, but not limited to, acts of nature, natural disasters, government directives, labor disputes, malfunctions in user hardware or software, interruptions in internet service, loss or corruption of data, and unanticipated suspension or termination of service.

User Accounts

To establish a user account, you are required to furnish your full name, an email address, your country or region of residence, a public username, and a user password. You commit to never disclose or share access or access information for your user account with any third party under any circumstances. During the setup of your user account, you may be prompted to provide additional optional information (e.g., level of education, year of birth). You assert that all information supplied by you is accurate and up-to-date. It is agreed that you will keep your information accurate and current by maintaining and updating it as necessary. We prioritize the confidentiality and security of your personal information. For further details, please refer to the Privacy Policy.

Course Alteration or Termination

The oktatacademy  PLATFORM, inclusive of course materials, may contain inaccuracies and omissions. We retain the right to rectify errors or omissions without prior notification. Furthermore, we reserve the authority to cancel, discontinue, reschedule, delay, change instructors, or modify any course or service.

License for Using oktatacademy PLATFORM Materials

Unless explicitly stated otherwise, the oktatacademy  PLATFORM and all its content, encompassing text, images, and the HTML employed for page generation (‘Material’), are released under the Creative Commons Attribution Non Commercial Share Alike 4.0 International (CC BY-NC-SA 4.0) license (creativecommons.org/licenses/by-nc-sa/4.0/). Certain content on the ONLINE oktatacademy contributed by third parties, and the utilization of such content is subject to stipulated rules and restrictions as indicated on the ONLINE oktatacademyBy accessing the platform, you commit to abide by all such rules and restrictions.

Trust & Safety

You commit to adhere to oktatacademy’s Trust & Safety policies, Restricted Topics policy, and other content quality standards or policies stipulated by Udemy periodically. It is advised to review these policies regularly to ensure compliance with any updates. Your utilization of the Services is contingent upon oktatacademy’s approval, a discretion we may exercise to grant or deny at our sole discretion.

We retain the prerogative to remove content, suspend payouts, and/or ban instructors for any reason at any time, without prior notice, including instances where:

  • An instructor or content fails to comply with our policies or legal terms (including the Terms of Use).
  • Content falls below our quality standards or has an adverse impact on the student experience.
  • An instructor engages in behavior that may reflect unfavorably on oktatacademy or bring it into public disrepute, contempt, scandal, or ridicule.
  • An instructor collaborates with a marketer or other business partner who violates oktatacademy policies.
  • An instructor uses the Services in a manner constituting unfair competition, such as promoting their off-site business in violation of oktatacademy policies.
  • As determined by oktatacademy in its sole discretion.
  • Co-Instructors and Teaching Assistants

The oktatacademy platform allows you to designate other users as co-instructors or teaching assistants for Submitted Content under your management. In doing so, you must adhere to our Co-Instructor Relationship Rules and Guidelines. By appointing a co-instructor or teaching assistant, you acknowledge authorizing them to take specific actions affecting your Udemy account and Submitted Content. Violations of Udemy’s terms and policies by your co-instructor or teaching assistant may impact your Udemy account and Submitted Content. Udemy is unable to offer guidance or mediate disputes between you and such users. If your co-instructors have an assigned revenue share, it will be paid out of your earned revenue share based on the ratios specified in your Course Management settings as of the date of purchase.

Relationship with Other Users

Instructors maintain no direct contractual relationship with students; therefore, the information you receive about students is limited to what is provided through the Services. You commit to using the data received solely for the purpose of delivering your services to those students on the oktatacademy platform. Furthermore, you agree not to seek additional personal data or store students’ personal information outside the oktatacademy  platform. It is agreed that you will indemnify oktatacademyagainst any claims arising from your use of students’ personal data.

Anti-Piracy Measures

We collaborate with anti-piracy vendors to safeguard your content against unauthorized use. To facilitate this protection, you hereby designate oktatacademy and our anti-piracy vendors as your agents for enforcing copyrights for each of your content through notice and takedown processes (as per applicable copyright laws like the Digital Millennium Copyright Act) and other endeavors to uphold those rights. You confer primary authority upon oktatacademy and our anti-piracy vendors to file notices on your behalf in order to protect your copyright interests

You acknowledge that oktatacademy and our anti-piracy vendors will retain the aforementioned rights unless revoked by you through an email sent to takedowns@oktatacademy.com with the subject line: “Revoke Anti-Piracy Protection Rights” from the email address associated with your account. Any revocation of rights will become effective 48 hours after receipt.

Content Ownership

The Parties recognize that each Learner maintains all rights in content created as part of a Course, such as submitted homework, forum posts, and the like (“Learner Content”). Consequently, the use of Learner Content requires appropriate Learner consent, which may be specified in advance by the Instructor when the Learner commences a Course. oktatacademy will actively secure Learner Consent for Partners to utilize Learner Content in courses exclusively with their Registered Students.

Other Content. In the relationship between the Parties, oktatacademy and its licensors maintain all rights to the Platform, oktatacademy Properties, Platform Services, other oktatacademy products, and all content (excluding Partner Course Content and Learner Content) utilized or generated in connection with the aforementioned. This includes the ownership of improvements to the Partner Course Content not provided by Learners as part of the Course, such as Course Content translations facilitated by oktatacademy through crowdsourcing, translation vendors, or alternative means (referred to as “Course Enhancements”).

You commit to utilizing the oktatacademy PLATFORMs in compliance with all applicable laws. You bear responsibility for your own communications, encompassing the upload, transmission, and posting of information, and are accountable for the consequences of such postings on or through the oktatacademy PLATFORM. Moreover, you agree not to email or post malicious or harmful content anywhere on the oktatacademy PLATFORM, including, but not limited to, the following:

  • Content that defames or threatens others.
  • Harassing statements or content that violates federal or state law.
  • Content that discusses illegal activities with the intent to commit them.
  • Content that is not your own or infringes on another’s intellectual property, including, but not limited to, copyrights, trademarks, or trade secrets.
  • Content related to partisan political activities.
  • Material containing obscene (i.e., pornographic) language or images.
  • Advertising or any form of commercial solicitation or promotion, including links to other ONLINE LEARNING PLATFORMs.
  • Content that is otherwise unlawful.
  • Intentionally incomplete, misleading, or inaccurate content.

 

Violations of the Honor Code.

Material protected by copyright, including but not limited to software, graphics, text, photographs, sound, video, and musical recordings, must not be uploaded to the ONLINE LEARNING PLATFORM without explicit permission from the copyright owner or other legal entitlement to use the material.

Security Rules

Violations of system or network security may lead to civil or criminal liability. The Partners will investigate occurrences and may engage, and collaborate with, law enforcement authorities to prosecute individuals or users involved in such violations. You commit to refraining from violating or attempting to violate the security of the ONLINE LEARNING PLATFORM, including but not limited to: attacking, probing, scanning, or testing the vulnerability of, breaching the security of, disrupting, disabling, or harming the ONLINE LEARNING PLATFORM or servers or networks connected to the ONLINE LEARNING PLATFORM using any automated means, such as a screen-scraper or robot. It is clarified that this is not intended to prohibit the use of assistive technology for personal use, such as screen-readers.

Content Disclaimer

The text and other materials on the oktatacademy  PLATFORM may express the views of specific instructors and do not constitute statements of advice, endorsement, opinion, or information from the Partners. If you anticipate that the content on the oktatacademy  PLATFORM might be offensive to you, it is advisable not to proceed. oktatacademy  LEARNING PLATFORM may also feature personal opinions and expressions by Users who post entries on various topics. The content of the forums and the links to other web oktatacademy  PLATFORMs are not screened, approved, reviewed, or endorsed by the Partners or any other affiliated entity. While the Partners reserve the right to remove content from the ONLINE LEARNING PLATFORM, block access, or take other actions concerning the material at their sole discretion.

User Content

You may be allowed to submit and share materials related to an online course (‘User Content’). By doing so, you assert and guarantee that any material you submit to the oktatacademy PLATFORM, instructors, or other Users is accurate and complete, and it will not violate or infringe upon the rights of any third party. This includes, without limitation, privacy, publicity, intellectual property, and other proprietary rights, such as copyright, trademark, and patent rights. You further affirm and warrant that you possess all necessary rights and licenses to use the material and authorize its use by the Partners and other researchers. In the event of a third-party claim asserting that any material you contributed to an oktatacademy  PLATFORM is unlawful, you agree to bear the burden of proving that the material complies with all applicable laws. While the Partners do not actively monitor the content of the oktatacademy  PLATFORM, they retain the right to remove material from the oktatacademy PLATFORM, block access, or take other actions concerning the material at their sole discretion.

 Updating These Terms

Periodically, we may update these Terms to clarify our practices or to reflect new or different practices, such as the addition of new features. Oktatacademy reserves the sole discretion to modify and/or make changes to these Terms at any time. In the event of any material changes, we will notify you using prominent means, such as sending an email notice to the address specified in your account or posting a notice through our Services. Modifications will take effect on the day they are posted unless otherwise stated.

Your continued use of our Services after changes become effective signifies your acceptance of those changes. Any revised Terms shall supersede all previous Terms.

Use of your Personal Information

By providing any personal information to the oktatacademy PLATFORM, all users fully understand and unambiguously consent to the collection, transmission, processing, and storage of such information by Partners. Furthermore, users consent to the use of such information for research by the Members and other international researchers.
